Agreement to Terms

By downloading, installing, or using autosaurus ("the App"), operated by Autogenic Labs LLC ("Company", "we", "us", or "our"), or accessing our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Service

autosaurus is a desktop application for macOS that helps content creators track and analyze their Sora metrics. The App collects and displays analytics data locally on your device.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

User Responsibilities

When using autosaurus, you agree to:

  • Use the App only for lawful purposes and in compliance with applicable laws
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App to collect data in violation of third-party terms of service
  • Maintain the security of your device and any accounts connected to the App
  • Not redistribute or resell the App or any part of it

Intellectual Property

autosaurus, including its design, code, graphics, and content, is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes in accordance with these terms.

Data and Privacy

Your use of autosaurus is also governed by our Privacy Policy. The App processes analytics data locally on your device. You are responsible for:

  • Backing up any data stored by the App
  • Ensuring you have the right to access the analytics data you track
  • Complying with any applicable data protection regulations

Disclaimer of Warranties

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of analytics data

We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOGENIC LABS LLC, AUTOSAURUS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP OR SERVICES.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT RESPONSIBLE FOR ANY ACTIONS TAKEN BY THIRD-PARTY PLATFORMS INCLUDING BUT NOT LIMITED TO:

  • Account suspension, termination, or banning
  • Shadow-banning or reduced visibility
  • Loss of followers, likes, or engagement
  • Changes to platform algorithms or policies
  • Loss of access to any social media or content platform
  • Any other adverse action by Sora, OpenAI, or related services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

AI-Generated Content

The App may facilitate the creation, scheduling, or management of AI-generated video content. You acknowledge and agree that:

  • You are solely responsible for all content created using or through the App
  • AI-generated content may be unpredictable and we make no guarantees about its quality, accuracy, or appropriateness
  • You must ensure all content complies with applicable laws, platform policies, and third-party rights
  • We are not liable for any claims arising from content you create, publish, or distribute
  • You are responsible for reviewing all AI-generated content before publishing

WE DISCLAIM ALL LIABILITY FOR COPYRIGHT CLAIMS, INTELLECTUAL PROPERTY DISPUTES, DEFAMATION, OR ANY OTHER CLAIMS ARISING FROM AI-GENERATED CONTENT CREATED USING THE APP.

Automation Features and Assumption of Risk

The App includes automation features for engagement, scheduling, and content workflows. By using these features, you acknowledge and accept:

  • Automated actions may violate third-party platform terms of service
  • You assume all risk associated with using automation features
  • Platform policies change frequently and without notice
  • We do not guarantee that any feature complies with any platform's current terms
  • You are solely responsible for understanding and complying with all applicable platform rules

YOUR USE OF AUTOMATION FEATURES IS ENTIRELY AT YOUR OWN RISK. WE STRONGLY RECOMMEND REVIEWING THE TERMS OF SERVICE OF ANY PLATFORM YOU USE IN CONJUNCTION WITH THE APP.

Indemnification

You agree to indemnify, defend, and hold harmless Autogenic Labs LLC, autosaurus, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any content you create, publish, or distribute using the App; or (e) any violation of applicable laws or regulations.

Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Class Action Waiver

YOU AGREE THAT ANY CLAIMS AGAINST AUTOGENIC LABS LLC OR AUTOSAURUS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You expressly waive any right to bring or participate in any class action, collective action, or representative action against us.

No Guarantees of Results

We make no guarantees regarding the results you may achieve using the App, including but not limited to follower growth, engagement rates, video performance, or monetization. Any testimonials or examples are not guarantees of future results. Your success depends on many factors outside our control.

Age Requirement

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Third-Party Services

autosaurus may interact with third-party services (such as Sora). We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of such services is subject to their respective terms and conditions.

Updates and Modifications

We may release updates to the App that modify features, fix bugs, or improve performance. While we strive to maintain backward compatibility, updates may occasionally change how the App functions. Continued use of the App after updates constitutes acceptance of any changes.

Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend access to our services for users who violate these terms or engage in harmful activities.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Delaware.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Autogenic Labs LLC regarding the use of the App and supersede all prior agreements, representations, and understandings.
